Every new project in SOCCSKSARGEN passes through the same DENR-EMB gates in the same order: coverage under the EIS System before construction, permits before operation, reports during operation. What differs is which gate bites hardest for your type of project.
The common sequence for every project
Before construction
- ECC or CNC under PD 1586 and DAO 2003-30, screened against Proclamation 2146 and the EMB MC 2014-005 thresholds. Construction, including site clearing, before the ECC is a violation (PD 1586 Section 9; DAO 2003-30 Section 16). Our ECC vs CNC guide explains the screening.
- Zoning or locational clearance, barangay endorsement and land documents; EMB Region XII asks for them with the application.
- Authority to Construct for new air pollution sources that require it under DAO 2000-81 Rule XIX Section 3, before installation.
Before operation
- Pollution Control Officer designated and submitted for accreditation within 15 calendar days (DAO 2014-02 Section 8; fee ₱500).
- Wastewater Discharge Permit under RA 9275 Section 14 and DAO 2005-10 for any outfall, with effluent meeting DAO 2016-08 Table 9 as amended by DAO 2021-19.
- Permit to Operate for every genset, boiler, dryer or other source (DAO 2000-81 Rule XIX Section 1).
- Hazardous waste generator registration under RA 6969 and DAO 2013-22, filed online with EMB Region XII, which issues a DENR ID number; used oil, busted lamps and empty chemical containers count.
- Solid waste arrangements under RA 9003: segregation at source and collection or disposal with the LGU; no open burning.
During operation
- Quarterly Self-Monitoring Report (DAO 2003-27; DAO 2014-02 Section 12) and, for projects with an ECC, the semi-annual Compliance Monitoring Report (DAO 2003-30 Section 9.2).
- 24-hour incident and exceedance reports (DAO 2014-02 Section 10).
- Renewals before expiry (Permit to Operate at least 30 days before, DAO 2000-81 Rule XIX Section 8; PCO accreditation every three years) and amendments for any expansion or change in process, area or capacity.
Resorts and tourism projects
- Coverage. Resorts are a listed project type in MC 2014-005 Annex A: not covered up to 0.1 hectare, IEE Checklist above 0.1 and below 5 hectares, EIS at 5 hectares and above, measured as gross floor area of structures plus open areas, parking and pools. Almost every Sarangani beach site sits in an Environmentally Critical Area because of mangroves, reefs and fisheries, so expect EMB to look closely at location.
- Other clearances. Sites inside or beside protected areas under the NIPAS Act (RA 7586, as amended by RA 11038), such as the Sarangani Bay Protected Seascape, need Protected Area Management Board clearance, and structures on foreshore land need a separate DENR foreshore lease; confirm which apply to your site.
- Wastewater. The Kapatan-Lago beach line in Glan and the Kamanga-Colon beach line in Maasim are listed as Class B recreational waters in EMB Region XII's monitoring: BOD 30 mg/L at the outfall under DAO 2016-08 Table 9, plus the fecal coliform, ammonia and phosphate limits revised by DAO 2021-19. A septic tank will not get there; plan a sewage treatment plant and a Discharge Permit, tested for the resort parameters (PSIC 55): BOD, fecal coliform, ammonia, nitrate, phosphate, oil and grease, surfactants.
- Air. Standby gensets need a Permit to Operate; several units can be grouped in one application (DAO 2000-81 Rule XIX Section 5).
- Waste and reports. Quarterly SMR; CMR if you hold an ECC; a Category A PCO is usually enough for a small resort.
Subdivisions and housing projects
- Coverage. Under MC 2014-005 Annex A, subdivisions are not covered up to 1 hectare; IEE Checklist above 1 hectare and below 25 hectares on flat land (below 5 hectares on critical slopes); EIS at 25 hectares and above on flat land (5 hectares on critical slopes). Flood-prone land along the Marbel or Alah rivers, prime agricultural land and slopes are ECAs. Phasing a 30-hectare project into six 5-hectare phases to stay under the EIS line does not work; DAO 2003-30 Section 3(b) treats phased projects by the same proponent as one undertaking.
- DHSUD. Banks and DHSUD commonly ask for the ECC or CNC as part of their own requirements, so the EMB step comes first; confirm the current DHSUD checklist.
- Wastewater. A communal sewage treatment plant with an outfall needs a Discharge Permit, tested for the real estate parameters (PSIC 681): BOD, fecal coliform, ammonia, nitrate, phosphate, oil and grease, surfactants. Discharge toward the Class C Marbel River in Koronadal City or the Silway River in General Santos City means BOD 50 mg/L and TSS 100 mg/L.
- Drainage, trees and solid waste. ECC conditions commonly cover drainage, slope protection, water-body easements and tree planting; cutting existing trees needs a DENR permit under the Revised Forestry Code (PD 705). Permits and ECC conditions follow the project after turnover to the homeowners' association.
Fuel stations
- Coverage. Refilling and gasoline stations are a listed project type in MC 2014-005 Annex A, with total storage capacity as the size parameter: not covered up to 20 kL (a CNC may be secured); IEE Checklist-based ECC above 20 kL and below 20,000 kL.
- DOE. Retail fuel outlets are also regulated by the Department of Energy separately from EMB; confirm the current DOE requirements for the site and tanks.
- Wastewater. Forecourt runoff and wash bay water pass through an oil-water separator with an outfall, which needs a Discharge Permit. Parameters for fuel retail (PSIC 47300): TSS, oil and grease, benzene, toluene, ethylbenzene and xylenes; the oil and grease limit is 5 mg/L for Class B and C waters.
- Hazardous waste. Used oil, oily rags and spent filters make every station a generator; register with EMB Region XII, keep manifests and Certificates of Treatment for every haul, and keep the contingency plan DAO 2013-22 requires on site.
- PCO. DAO 2014-02 Section 7 expressly allows the station manager to be the PCO of a gasoline station, as a Category A establishment, if the basic requirements are met.
Factories and processing plants
- Coverage. Screen the plant by type and capacity under MC 2014-005 Annex A. Heavy industries are ECPs needing a full EIS through the EMB Central Office. Fish and meat processing and canning plants take an IEE Checklist above 200 and below 2,500 MT a year and an EIS at 2,500 MT and above; ice plants take an IEE Checklist regardless of capacity; rice and corn mills above 1 tonne per hour, or with polishing, take an IEE Checklist. An existing plant without an ECC applies with an EPRMP and pays the fine first.
- Wastewater. Every process outfall needs a Discharge Permit with the sector's significant parameters: fish processing (PSIC 1020) is temperature, pH, BOD, TSS, nitrate and oil and grease. Plants discharging to Sarangani Bay's Class SB stations must meet BOD 30 mg/L and TSS 70 mg/L; plants on the Silway or Klinan rivers meet Class C limits. Strong wastewater (influent BOD of 3,000 mg/L or more) follows DAO 2016-08 Section 7.3 and Table 10 for BOD. See the effluent standards guide.
- Air. Boilers, dryers, kilns, gensets and control devices each need a Permit to Operate, with an Authority to Construct for new sources that require it; stack sampling applies under EMB MC 2007-003 and your permit conditions.
- PCO category. Discharges of 30 m³/day or more, boilers of 50 HP or more, gensets of 300 kW or more, or sources requiring stack sampling make the plant Category B under DAO 2014-02 Table 1, which requires a licensed engineer or chemist or an equivalent professional.
- Chemicals, funds and reports. Register as a hazardous waste generator and check the Priority Chemical List under RA 6969 for chemicals you use. Category A projects set up a Multipartite Monitoring Team with an Environmental Monitoring Fund (DAO 2003-30 Section 9.1). Quarterly SMR; semi-annual CMR.

- Coverage screening done in writing; ECC or CNC application filed before any site work.
- Zoning or locational clearance, barangay endorsement and land documents on file; Authority to Construct secured for new air sources that require it.
- PCO designated; accreditation filed within 15 calendar days; managing head's 8-hour training done.
- Receiving water body class confirmed with EMB Region XII; treatment designed to that column of the standards.
- Effluent sampled for the Table 8 significant parameters at a DENR-recognized laboratory; Discharge Permit application filed with Engineer's Report and drawings.

What is the first environmental permit I need for a new project?
The ECC or CNC under PD 1586 and DAO 2003-30. It comes before construction and before most LGU, DHSUD and bank steps; Discharge Permits and Permits to Operate come before operation.
Does a small beach resort in Sarangani need an ECC?
Usually yes: resorts above 0.1 hectare are a listed project type under MC 2014-005, and coastal areas with mangroves, reefs or fisheries are Environmentally Critical Areas. EMB screens size and site and decides between an IEE Checklist-based ECC and a CNC.
Does a fuel station need a Discharge Permit?
If the oil-water separator or wash bay drains to a canal or creek, yes. RA 9275 Section 14 requires a permit for facilities that discharge regulated effluents.
Which permits does a rice mill with a rice-hull-fired dryer need?
An ECC or CNC (an IEE Checklist above 1 tonne per hour or with polishing), a Permit to Operate for the dryer and any genset, a Discharge Permit if there is a wastewater outfall, hazardous waste registration for used oil, and an accredited PCO filing quarterly SMRs.
Who do we file with in Region XII?
EMB Region XII at the Regional Government Center, Barangay Carpenter Hill, Koronadal City, South Cotabato, for Category B, C and D applications and for permits; EIS-based ECCs for Environmentally Critical Projects go to the EMB Central Office. Cotabato City and the Bangsamoro region fall under the Bangsamoro Government, which holds pollution-control powers under RA 11054; confirm the correct office for your barangay.
